Idol controversy: Did producers rip-off 'American Band' idea?

American IdolLast week, the producers of American Idol made a surprise announcement about the launch of a new reality show, called The Next Great American Band. However, the producers of a different reality competition, called America's Hot Musician, are claiming that they had the idea first -- and they're trying to halt the production of Idol's spin-off.

America's Hot Musician is the brainchild of American Youth Symphony (AYS), a non-profit whose mission is "to promote instrumental music in the MTV/Hip Hop Generation," says AYS Artistic Director Gregory Charles Royal.

According to Variety, Cecile Frot-Coutaz claims that FremantleMedia decided to do their show at the end of last year's Idol. "We sort of thought it was a no-brainer and asked ourselves why we hadn't thought of it before. It was a natural extension of Idol."

But Royal claims that AYS spoke with FremantleMedia in February 2006 -- months before last year Idol ended -- "as a good faith measure to alert them about our program and to make sure no potential legal conflicts existed." AYS "shared our format and title ideas and were given a greenlight as far as they were concerned. Their only caveat was against any use of the word Idol in our title."

Susan Veres, the Executive Director of AYS said, "We may seek some sort of injunctive relief because aside from the possible copyright issues, the FremantleMedia producers seem, according to published reports, intent on rushing their show to the marketplace, which would be in direct competition with our program set to air beginning July."

The two shows are said to share a very similar format, although from what I can tell they don't seem to be exactly the same. Idol will be searching for bands with vocalists. American's Hot Musicians is seeking instrumental musicians only, and specifically excludes vocalists and rappers from the competition. I also believe (the details still aren't clear) that the winner of Idol's American Band will be a group of people (an actual band), while American's Hot Musician will award a recording contract to only the top instrumental musician -- not a group.

So while there are similarities, there also seems to be significant differences. Besides, most reality shows, especially these "talent searches," take the same basic format and just wrap it in new, fancy clothing anyway. Aren't they all just copycats in one way or another? Sure, it's unfortunate to have to compete against the powerhouse known as American Idol, but then again, until yesterday, I'd never heard of the American Youth Symphony or their show, America's Hot Musician. I'm not saying I totally doubt their copyright infringement claim. I'm just saying that win or lose this battle, the only reason we're talking about America's Hot Musician is because it involves yet another Idol controversy. Publicity-wise, it doesn't hurt to hint at a possible legal battle with the most-watched show on TV. Even if you know it's a battle you probably can't win.

American Idol didn't invent televised talent shows, but it certainly perfected the format in the last couple of years. Elements like the nationwide searches and celebrity judging are all courtesy of Idol. Like others, the producers of America's Hot Musician have merely adapted this model, and therefore can't really accuse Idol of ripping them off. Can they?

First-- Who knows WHAT the IDOL producers
do or don't do... it's all covert, it's all bathed in
murky big-bizness goo. For all anyone really
knows, the PRODUCERS could have manufactured
the whole "bad-singer-stays-on-and-on" while
more talented ones were dropped... it sure drew
lots of free publicity. How does the public know
that the whole voting-by-phone thing is not
the "Wizard behind the curtain" pulling levers
and laughing his buns off?
Second-- if "the vote" is a true reflection of
public taste (and not just another production
gimmick) then it merely shows how pathetically
inadequate the callers-in are when it comes to
evaluating musical artistry.
Third-- Why discontinue such a well-oiled
circus? At least, one gets to hear SOME finely-
tuned singers, and a band that can "cook" on
any sort of material!!!

Well it wouldnt be the first time AI stole an idea. Back in the day before AI there was another show with the similar format as AI but was missing something. My best friend was in the business at the time and he was asked was was missing from the show...he replied "ME" My friend who is a sarcastic, no-holes barred type of personality. Thus Simon was born but instead of using the the person from which the idea came from and would have been better than SImon...Fox took the idea and profitted big time on it. Reality shows need to go bye-bye and TV needs to bring back true family entertainment....Has anyone noticed but there are no family sitcoms or shows on anymore..everything is dramas or reality...where has American values gone.

I love watching American Idol, and assumed it was a "raw talent" competition. I think it is unfair to put profesional singers like Melinda up against young, great talent like Jordin and Blake and I really did like Chris, he was so much like Timberlake, and could have had a chance if professional that have performed for money, were not in the competition. Jordin is the fresh young face that America needs to be a role model for young Americans. No, she cannot bump and grind like Melinda, nor should she need to. I hope someone in America will agree with me. Please respond and let Fox know that we want a "true American Idol, and not a "DIVA".

i think molinda shouldn't of made this far. she got paid for singing and there is no chance for the others. i think jordan. should win this and molinda go home this week. she can gett a contract.

Well, if American Band keeps its title, I'd love a break from
No Doubt's break-up. I hope there's a band out there
that will not only be as great as N-Sync & Backstreet,
but they will attract more attention on MTV than the
recent Menudo band forming on MTV3, right now, if not
keep us in suspence for a reunion of my favorite rock
band, No Doubt. I'm tired of American Idol churning out
single musical celebrities that never get past one year
before they fizzle out, so if there was going to be a
revolutionary band that will change the face of their
merchandising even beyond KISS, I'd follow and tape
everything on American Band and beyond to follow it,
until I saw that American Band in concert, whoever they
turned out to be, just as long as they weren't a loud
scream-singing heavy metal band like you hear today.

It's absurd that anybody can stake a claim to an idea as generic as "battle of the bands".

I've been thinking that Idol should do a band spin-off for ages. I can't believe it took them this long to finally go ahead with it.
