Class action lawsuit filed against Hannah Montana

by Jackie Schnoop, posted Nov 14th 2007 12:41PM
Miley Cyrus AKA Hannah MontanaMiley Cyrus, also known as Hannah Montana, has a very active fan club, much as other teen sensations have had over the years. The benefits for those in such a fan club usually include memorabilia, little fan goodies, the latest news about the star and, in this case, the fans believe they were promised easier access to Miley's concert appearances.

Yes, the fan club members believed they would have access to priority seating at the sold-out concerts of Miley, the daughter of Billy Ray Cyrus. As Hannah Montana on the Disney Channel, her current fame eclipses any achy breaky heart past glories. She's the fourteen year-old whose fans are really fanatics in all meaning of the word.

In Tennessee, a lawsuit was filed which claims that the fan club bosses knew they wouldn't be able to meet the demands for concert tickets. Companies targeted in the lawsuit, Interactive Media Marketing and Smiley Miley, are being sued for triple damages for all members of the lawsuit plus court costs.

The lawsuit, in the name of a New Jersey woman who joined the fan club at MileyWorld.com mainly for the promise of concert ticket ease, claims the lawsuit is "for all fans who feel similarly situated." According to the attorney representing the fans in the class action lawsuit, "While the club and the website do not guarantee ticket availability, they explicitly state that members who log on shortly after tickets become available, they will have a good opportunity to get tickets."

MileyWorld claims the lawsuit is frivolous.

The real problem was this: When a person (any person - not just a fan club member) went on the Ticketmaster site to purchase the presale tickets, there was a box on that page to sign up for the fan club to get immediate access to the presale tickets. THIS is what was unfair about the presale and THIS is what the lawsuit is about. As a fan club member, we were promised presale access BEFORE the general public - not at the same time as any Joe Schmoe could get them, too. Completely unfair and not what fan club members signed up for. I have signed up for several fan club sites to get access to tickets and have never seen such a money-grabbing display of disloyalty towards the fans as I did with the MileyWorld group. Is it the 15 year old's fault - of course not! However, it is the MileyWorld corporation's fault. FYI - the methods have been changed because of the fallout. No longer does that ticketmaster page display immediate signup for MileyWorld. Some good has come from this.

Sorry, I'm not feeling the "pain" on this one! I'm all about standing up and shouting out....but does this "issue" really impact the quality of our lives?

The problem is the scalpers but also its the parents willing to pay these crazy prices for anything their child wants (this goes for these tickets, the christmas present that goes on ebay for double what the are worth-example the wii-ect.). My daughter loves Hannah Montana she wanted to go really bad to a concert, but I am a true believer you can't give your child everything they want, what kinda of life are you teaching them that they just have to want something and they can have it. Yeah my little girl was upset she didn't get to go, but she is over it now still my little angel and still happy and still knows I love her with all my heart.

Not saying your wrong if you bought your child the tickets. Just saying its because scalpers know that parents today love spoiling kids that they can buy out and get double even triple what something is worth. I think in the states (like Tn) where scalping is illegal they should be held responsible for not going after the scalpers Its not hard to find tickets online that are being scalped out there for these prices. I live near the race track in Bristol they tried to stop scalpers with race tickets why not go after them for any kind of tickets? Maybe instead of sueing why not go after states to make harder scalping laws and go after scalpers online to solve the problem for everyone.

Why pay to join a fan club? Most of these entertainers are selling their cds, tee's, etc.. on their websites and paying to join a fan club doesn't reduce the cost.
It's easier to sign up for their newsletters which contain special offers, tour and presale information for fans. Usually they have presales where seats are guaranteed within a certain area of the venue, eg first six rows-- I've gotten some great orchestra seats because of it.

Ah well... it's a good thing no one joined the Led Zeppelin fan club thinking they'd get tickets for the reunion tour--not that most could afford them anyway.

The club members aren't going to make any money or win anything, but, the lawyers will come out and be able to buy several Beamers with a lot left over. The lawyers are going to laugh all the way to their banks.

Class action suits and law suits only make the lawyers more wealthy.

I bought tickets for my daughter. Main floor row 8. You just have to be willing to part with some cash to get them.

tell ya the truth, suing seems to be the American way to get easy money outa others. If a dingy woman burns herself on hot coffee that she was told was hot and wins the suit, be careful how you breathe

First of all why have adults joined a 14yr old girls fan club? Now that should be investigated. Second of all why sue are you money hungry? Get a grip stuff happens. Why not join a fan club for her father instead, after all he is an adult more fitting for adult women. If your in this fan club than that must mean that you admire the young aspiring star so why sue her? Step out side your box and look at yourself. GROW UP!
